Terms of Service

Welcome to WaBus. These Terms of Service ("Terms") govern your access to and use of our SaaS platform, API endpoints, and dashboards. WaBus is developed, owned, and operated by Prashi Solution, a software company based in Gujarat, India.
1. Acceptance of Terms
By registering for an account, accessing our dashboard, or connecting a phone number, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these terms, you are prohibited from using our services.
2. Acceptable Use & Anti-Spam Policy
You agree to use our messaging services in full compliance with Meta’s Business Terms and local communication regulations. Specifically:
- No Spamming: Sending unsolicited bulk messaging, generic cold-outreach spam, or fraudulent templates is strictly prohibited.
- Opt-In Requirements: You must maintain proof of explicit opt-in consent from all recipient contacts before initiating outbound campaign template alerts.
- Account Termination: If our delivery reports detect high blocking/spam rates or Meta issues a display number ban, we reserve the right to immediately suspend or permanently terminate your WaBus account without refund.
3. Account Registration & Security
You must keep your account credentials and Open API keys secure. You are fully responsible for all campaigns dispatched, webhooks registered, and API usage charges accrued under your tenant credentials.
4. Subscription Billing, Refund & Cancellation Policy
- Billing Structure: SaaS subscription fees are billed in advance on a monthly or annual cycle. Prices exclude local taxes (e.g., 18% GST in India).
- Refund Policy: If you are unsatisfied with the platform, you may request a full refund within 7 days of your initial setup date, provided no active messaging campaigns have been sent. Subsequent renewals and standard usage charges are non-refundable.
- Cancellation: You can cancel your subscription at any time via your Billing settings. Cancellation will disable future auto-renewal charges, and your tenant dashboard will remain accessible until the end of the current paid billing cycle.
- Meta Conversation Fees: WhatsApp Business API conversation charges (per utility, marketing, authentication, or service category) are billed by Meta and are completely non-refundable.
5. Service Uptime & Availability
We target a 99.9% application uptime. However, we do not guarantee uninterrupted access, as our service relies on external API responses from Meta Platforms, Inc. and cloud infrastructure availability.
6. Intellectual Property Rights
All core codebases, designs, trademarks, routing middlewares, and dashboards are the exclusive intellectual property of Prashi Solution. You are granted a limited, non-exclusive, non-transferable license to access our platform during your subscription term.
7. Limitation of Liability
To the maximum extent permitted by law, Prashi Solution shall not be liable for any lost profits, customer churn, Meta business account bans, or indirect damages resulting from your use of the platform.
8. Governing Law & Jurisdiction
These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of India. Any legal disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts of Gujarat, India.
